The judgment of the Court of Justice of the European Union of 6 December 2017.
The purpose of the new law, according to its Explanatory Memorandum, is to “guarantee that the damages suffered by subjects [...] as a consequence of such anticompetitive practices be effectively compensated”.
It is expected that the CNMC will use more often this faculty in the future, as announced by its President.
