Portugal. Cartels and Leniency

Tânia Luísa Faria, Margot Lopes Martins, Afonso Marques dos Santos.

The legislation regulating cartels and leniency in Portugal is the Portuguese Competition Act, corresponding to Law No. 19/2012, of 8 May, as amended by Law No. 17/2022, of 17 August. Although the term 'cartel' does not appear as such in the list of prohibited conducts provided in the Competition Act, cartel activity, along with other collusive agreements and concerted practices, is prohibited under Article 9 (equivalent to Article 101 of the Treaty on the Functioning of the European Union (TFEU))
