At the time of the Court of Justice of the European Union’s (‘CJEU’) ruling in the case, 196 intra-EU Bilateral Investment Treaties (‘BITs’) were in force. Subsequently, in January 2019, the EU Member States issued a declaration agreeing to terminate existing BITs between them by means of an agreement.
